components and services are intended for use in high speed, high performance
motor racing. As such, V8 ROADSTERS LLC'S products, designs, components
and services are sold AS IS, AND WITHOUT ANY WARRANTY OR CONDITION,
EXPRESS, IMPLIED OR STATUTORY. V8 ROADSTERS LLC AND ITS PARENTS,
SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES AND SUPPLIERS SPECIFICALLY
DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not
allow the disclaimer of implied warranties, so the foregoing disclaimers may
not apply to you. This paragraph gives you specific legal rights and you may also
have other legal rights that vary from state to state.
Limitations of Liability. There are risks associated with high performance
motorsports that may result in property damage, serious injury, or death. As
such, the customer voluntarily accepts and assumes all such risks, dangers
and damages incurred in the purchase and use of the previously mentioned
products, designs, components and services, and by acceptance of this shipment
hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE V8
ROADSTERS LLC OR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS,
EMPLOYEES AND SUPPLIERS. IN NO EVENT SHALL V8 ROADSTERS LLC, ITS
PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES OR SUPPLIERS BE
LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF, CAUSED BY, OR ASSOCIATED WITH V8 ROADSTERS
LLC'S PRODUCTS, DESIGNS, COMPONENTS, AND SERVICES (HOWEVER ARISING,
INCLUDING NEGLIGENCE). Some states do not allow the exclusion or limitation
of incidental or consequential damages so the above limitation or exclusion may
not apply to you.
Disputes. By accepting this shipment or using any of V8 ROADSTERS LLC'S
products, designs, components, or services, you agree that any claim or dispute
you may have with or against V8 ROADSTERS LLC or its parents, subsidiaries,
affiliates, officers, employees, or suppliers must be resolved by a court located
in Hillsborough County, Florida. You agree to submit to the personal jurisdiction
of the courts located within Hillsborough County, Florida for the purpose of
litigating all such claims or disputes. This Agreement and any disputes arising
from or associated with V8 ROADSTERS LLC's products, designs, components,
or services shall be governed in all respects by the substantive laws of the State
of Florida, without regard to conflict of law provisions. Any cause of action
or claim you may have with respect to V8 ROADSTERS LLC's products, designs,
components, or services must be commenced within one (1) year after the
claim or cause of action arises. If V8 ROADSTERS LLC or its parents, subsidiaries,
affiliates, officers, employees, or suppliers prevail in any action against you,
the Court may award them their reasonable litigation costs associated with the
action, including attorney's fees.
